Establishing A Social Order: The Sunnah Way
Humans as social beings require company. The creation of Adam Alayhis salaam was complemented by Hawa, our first mother. The Almighty provided the first man a partner with whom to experience and witness His bounties.

Since, marriage is a Sunnah of the Prophets Alayhimus salaam. It is an institution that ensures orderly perpetuation of humans through their progeny, one of the goals of our Glorious Shariah.

The Shariah lays out guidelines in which marriage is contracted and maintained for it to serve society by maintaining a social order.

Not all marriages are ‘made in heaven’ though. It so happens that couples may have problems in their marital relations. Sometimes issues may be resolved through a reconciliatory process. In other instances, however, it happens that reconciliation remains elusive if not impossible.

Our Creator made it permissible for couples to separate in the interest of preservation of their faith, other higher goals and wider community interests.

The Jamiatul Ulama’s Social department is part of the Darul Ifta. The department looks at cases which are filed by spouses under different circumstances. Processes are instituted in order to resolve marital problems.

In situations where all avenues have been explored in the pursuit of reconciliation, the department facilitates conclusion of a marriage under terms agreeable to contending parties within the framework of Shariah.

Settlements include matters of custody of children as well as their maintenance, access rights of either of the parents and maintenance of a divorced wife in the period of iddah.

Where the validity of a marriage is doubted under Shariah, the department determines its status.

Annulment of marriages may also be an option in situations where a husband continues to keep a wife against her wishes based on valid reasons of Shariah.

This is yet another service from the Jamiatul Ulama which is rendered according to Shariah, without recourse to costly civil court battles.

We appeal to you to support this institution that establishes the observance of Shariah in social matters. Q and A

Question:
If the money a person has falls below the Nisaab rate after a few months from ones Zakaah date, does the Zakaah year start again when one again possesses Surplus Zakaatable wealth or does the Zakaah year of a person remain the same?

Answer:

If during the year a persons money falls below Nisaab (but not completely zero), then upon the completion of one year one should see whether the total in possession amounts to Nisaab or more. If it is above Nisaab, then Zakaat will be due on the amount in possession at the end of the Zakaat year. However, if the money is below Nisaab, then Zakaat will not be due on that amount.

Hajj Seminar
Well over 120 participants attended the Jamiatul Ulama Haj Seminar held at the Jamiatul Ulama Auditorium
Last Sunday, 22 August 2010. The seminar covered topics such as spiritual aspects of the journey of Hajj; Virtues of Hajj; Ihram, Umrah and Five Days of Hajj as well as Ziyaarah of Madinah.

Meanwhile, in Lenasia, classes are ongoing in Ramadan every Sunday after Thuhr at Saberie Masjid, Lenasia Ext 5.

Another programme is scheduled for Sunday 19 September 2010 from 09:15 to 13:00 at Masjid Saliheen, Lenasia Ext 13.

Pakistan Flood Relief

Soweto’s Masjid Project
The Jamiatul Ulama appeals to the Muslim community to contribute towards the final work on the Islamic centre in Orlando East in Soweto where a masjid is set for completion by the start of Ramadan.

The project, a joint initiative of the Jamiatul Ulama and Ikhwana Islamiya under Siddiqui Trust has seen the construction of a multipurpose facility of a masjid, madrasa classrooms and living quarters for an imam and a caretaker.

There is an outstanding amount of funds to be settled with contractors and the community’s contribution will go a long way in meeting the shortfall.

“Verily, there has come unto you a Messenger (Muhammad SAW) from amongst yourselves.
It grieves him that you should receive any injury or difficulty. He is anxious over you (to be rightly guided); for the believers (he is) full of pity, kind, and merciful.” (9:128)

• As compared to other days of the year, during the blessed month of Ramadan Rasulullah salallahu alayhi wasalam paid much more attention towards the social, physical and spiritual wellbeing of his companions and those around him.

• He sought various avenues and means in order to achieve these goals:

1. His salallahu alayhi wasalam teaching the Sahabah radhiyallahi anhum

Imparting education and the pristine teachings of Allah has been always among the central activities of the Ambiyaa alayhimus salaam and those who followed thereafter in their footsteps. Describing this quality of the beloved of Allah salallahu alayhi wasalam, Mu‘awiya bin Hakam radhiyallahi anhu narrates, ‘May my parents be sacrificed for him, I have not seen a better teacher than him; neither before him nor after him. By the oath of Allah, he did not scold me, he did not hit me, and he did not swear at me.’ (Muslim) Among his teachings during this month include: ‘If a person forgetfully eats during the month of Ramadan, there is neither a need to repeat the fast nor for any compensation to be paid.’ (Ibn Khuzaimah) ‘If a person involuntarily vomits whilst fasting, there is no need to repeat the fast. However, whoever voluntarily does so will have to repeat the fast.’ (Ahmad)

2. His salallahu alayhi wasalam encouragement towards good deeds
Abu Hurairah radhiyallahi anhu narrated that Rasulullah salallahu alayhi wasalam remarked, ‘Every good deed of the son of Adam is multiplied. One good deed is multiplied ten times and sometimes up to seven hundred fold. Allah says, ‘This is excluding fasting. Fasting is for me and I will reward it because the fasting person abstains from food and censual desires for my sake. For a fasting person there are two moments of joy: the joy at the time of breaking the fast and the joy upon meeting his Creator. Certainly, the smell which emanates from the mouth of a fasting person is more beloved in the eyes of Allah than the fragrance of musk.’ (Muslim) Ibn Umar radhiyallahi anhu narrated that Rasulullah salallahu alayhi wasalam said, ‘Performing Umrah during Ramadan is equivalent in reward to performing Hajj with me.’ (Bukhari)

3. His salallahu alayhi wasalam mercy towards his Ummah
The very mission of Nabi salallahu alayhi wasalam was encompassed by his quality of mercy and compassion, as the Qur’an declares, ‘And We have sent you (O Muhammad SAW) not but as a mercy for the Aalameen (mankind, jinn and all that exists).’ (21:107) Among the many, one illustration of this was his insistence of hastening the partaking of Iftaar as soon as the time sets in and the eating of food at the time of Sehri. Sahl bin Sa’d bin Sahl radhiyallahi anhu reports that Nabi salallahu alayhi wasalam said, ‘People will continue to remain on good so long as they hasten to partake of Iftaar (as soon as the time sets in).’ (Bukhari)

4. His salallahu alayhi wasalam meeting with delegations
Despite his engagement in the worship of Allah during this auspicious month, he continued to meet, welcome and fulfill the needs of those who visited him. Ibn Is-haq writes that it was during the month of Ramadan that Rasulullah salallahu alayhi wasalam returned from the expedition of Tabuk and in the very same month a delegation from the tribe of Thaqeef visited him. He ordered a tent be erected for their accommodation in a corner of the Masjid and Nabi salallahu alayhi wasalam made personal arrangements for their food.

5. His salallahu alayhi wasalam encouragement of charity
More than any other time of the year, this is a month of charity and giving. Rasulullah salallahu alayhi wasalam mentioned, ‘…whoever gives to a fasting person something for Iftar, his sins will be forgiven and he will be saved from Jahannam; he obtains as much reward as the fasting person (to whom he had given something for Iftaar) while the reward of the person is not reduced in any way.’The people asked: ‘O Rasulullah! All of us are not by the means to give something for the Iftaar of another. Rasulullah salallahu alayhi wasalam said, ‘This reward is even for a person who gives another a date, or a drink of water or milk (for Iftaar)…’ (Ibn Khuzaimah)

Natural Disasters: Trials or Tribulations

In the past few weeks there have been many disasters that have afflicted communities in Pakistan, India, Russia and China. Natural disasters bring to the fore the awesome power and qudrat of Allah.

As believers we do not merely regard them to be the result of global warming or any other scientific theory, we understand them to be trials and tests from the Almighty.

In numerous narrations found in Hadith literature Rasulullah Sallallahu ‘alayhi wasallam informs us when vices like deceitfulness, drinking, disobedience to parents and disrespect to the Masaajid become common then earthquakes, dust storms and floods will take place more often.

It is a sad indictment on us as an Ummah that these vices prevail in our communities as well. Especially in this month of Ramadan, let us reform and seek forgiveness from the Almighty.

Let us also remember that even the periods of relative ease we enjoy in our country are also a test for a believer. ...And We test you [all] through the bad and the good (things of life) by way of trial: and unto Us you all must return." (21:35) May the Almighty protect us and not put a burden on us we cannot bear.

Our sympathy and hearts go out to the victims of these calamities, in many instances they are the poorest of the poor.

It is encouraging to note that Muslim-based organisations have led in the relief efforts of the flood-stricken and displaced in Pakistan. We appeal to all to continue supporting these organisations as the needs of Pakistan are great.

We make dua that Allah grants all the victims and their families sabr jameel. May Muslims emerge from these tests with firmer resolve and belief. May Allah reward all that have contributed towards the alleviation of the difficulties of the victims. Ameen.
